Service Terms
These Service Terms ("Terms") govern your access to and use of the Folioki service — the account, the library that syncs across your devices, the cards, and the AI-assisted learning features (together, the "Service"). They are entered into between you and Folioki ("we", "us"), whose operator and postal address are named in the Imprint.
The Folioki app itself is licensed to you separately, under Apple's standard licence — see section 2. By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. The Service
Folioki is a language learning application. It lets you import reading material, synchronize your library across your devices, create and review flashcards, and use optional AI-powered translation and explanation features.
Some features are free and some require a paid subscription. Which is which may change as the Service develops; a change never applies retroactively to a subscription period you have already paid for.
2. Relationship to the Apple Standard EULA
The Folioki application is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), which governs your licence to install and run the app.
These Terms govern the Service around it: your account, the content you upload, the server-side features, and the subscription that unlocks them. They do not replace, and are not intended to conflict with, the Apple Standard EULA.
Where these Terms and the Apple Standard EULA conflict on a licensing question — the scope of the licence to the application, its permitted uses, or its restrictions — the Apple Standard EULA prevails. In all other respects these Terms apply.
3. Eligibility
You must have the legal capacity to enter into this agreement under the laws applicable to you. If you are below the minimum age required in your country to consent to such an agreement and to the data processing described in our Privacy Policy, you may use the Service only with the permission of a parent or legal guardian, who accepts these Terms on your behalf.
4. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Tell us at [email protected] if you believe your account has been used without your permission.
You agree to provide accurate account information and to keep it up to date.
5. Your Content
You retain ownership of everything you upload, import, or create in the Service — books, articles, notes, and cards ("Your Content").
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, process, and display Your Content, and to send the parts of it you ask about to the AI services described in our Privacy Policy, for the sole purpose of operating and providing the Service to you. This licence exists only so that the Service can function; it ends when you delete the content or your account, subject to short-lived backups and to any retention the law requires of us.
We do not use Your Content to train our own models, and we do not sell it.
6. Copyright of What You Import
You are solely responsible for the material you bring into the Service. You represent and warrant that you own it, or otherwise hold the rights, licences, and permissions needed to use it in the Service and to grant us the licence in section 5.
The Service is a private reading and study tool: it does not publish Your Content or make it available to other users. Importing a book you have lawfully acquired for your own reading is what it is for; using it to distribute material you have no right to distribute is not.
Where we reasonably believe that applicable law or the rights of others are being violated, we may remove the content concerned or suspend the account. If you believe material in the Service infringes your rights, write to [email protected].
7. AI Features
Some features use artificial intelligence to generate translations, grammar explanations, definitions, and study material.
AI-generated output can be incomplete, misleading, or simply wrong, and you should treat it as a study aid rather than as an authority. It is provided for educational purposes only and is not legal, medical, financial, or other professional advice. Verify anything that matters.
AI features depend on third-party providers and on limits we set per plan. We may change those limits, or the providers behind them, to keep the Service viable.
8. Subscriptions and Billing
Paid plans are auto-renewable subscriptions sold through the Apple App Store. Payment is charged to your Apple Account at confirmation of purchase.
A subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends. Prices are shown in the app before you buy and may differ by region.
You manage and cancel subscriptions in the App Store settings of your device, not through us; deleting the app does not cancel a subscription. Refunds are handled by Apple under its own terms — we cannot issue them, but we will help you where we can.
Apple is responsible for payment processing, billing, renewal, and refunds, in accordance with the terms of the App Store.
9. Right of Withdrawal
If you are a consumer in the European Union, you have the right to withdraw from a contract for digital content within 14 days, without giving reasons. Because a subscription gives you immediate access to the paid features, you expressly consent, when you purchase it, to us beginning performance immediately, and acknowledge that you thereby lose your right of withdrawal once performance has begun.
Purchases made through the App Store are refunded by Apple; a withdrawal or refund request for a subscription should be directed to Apple.
10. Acceptable Use
You agree not to:
- use the Service for unlawful purposes;
- upload content you are not authorized to use;
- attempt to interfere with or disrupt the Service or its infrastructure;
- bypass usage limits, quotas, or technical restrictions;
- use the Service to build or train a competing product;
- reverse engineer the Service except where the law expressly permits it.
11. Availability and Changes to the Service
We may modify, suspend, or discontinue parts of the Service. Where a change materially reduces what a paid plan gives you, we will tell you in advance and, if you do not accept it, you may cancel; Apple handles any refund for an unused period.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. Maintenance, third-party outages, and network failures happen.
12. Our Intellectual Property
Except for Your Content and the third-party material in section 13, all intellectual property rights in the Service — the software, the interface, the name, and the logo — belong to us or our licensors and are protected by applicable law. Nothing in these Terms transfers any of those rights to you.
13. Third-Party Content and Licences
Dictionary entries in the cards come from Wiktionary and are used under the Creative Commons Attribution-ShareAlike 4.0 licence; the entries are reshaped to fit a card. The app is set in Montserrat, used under the SIL Open Font License. The full licence texts are in the app, under About → Licenses.
14. Disclaimer
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, and we disclaim all warranties other than those that cannot legally be excluded. Statutory warranty rights of consumers are unaffected.
15. Liability
We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we are liable only where we breach an obligation whose fulfilment is essential to the performance of these Terms and on which you may reasonably rely (a "cardinal duty"), and in that case only for the foreseeable damage typical of this kind of contract.
Any further liability is excluded. This does not shift the burden of proof to your detriment.
Because the Service is a study tool rather than a backup service, keep your own copies of anything you import that you cannot afford to lose.
16. Suspension and Termination
You may stop using the Service and delete your account at any time, from within the app. Deleting the account deletes Your Content as described in the Privacy Policy; a subscription is cancelled separately, in the App Store.
We may suspend or terminate your access if you materially breach these Terms, or where the law requires it. Where it is reasonable to do so, we will warn you first.
17. Changes to These Terms
We may update these Terms as the Service develops or as the law requires. Material changes take effect on publication of the updated Terms and, for existing users, are announced in the app or by email. Your continued use of the Service after that constitutes acceptance. If you do not accept a change, stop using the Service and cancel any subscription.
18. Governing Law and Disputes
These Terms are governed by the laws of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. As stated in our Imprint, we are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
19. Apple
Apple is not a party to these Terms and is not responsible for the Service, its content, or any claim arising from it; any such claim is between you and us. Apple and its subsidiaries are, however, third-party beneficiaries of the Apple Standard EULA referred to in section 2 and may enforce it against you as a third-party beneficiary.
